Father files FIR against Anand Mahindra after son dies in a Scorpio accident: Airbags didn’t deploy

An FIR has been filed against Mahindra Group chairman Anand Mahindra and 12 others in Kanpur following a complaint from a resident of the city. The complaint alleges that “false assurances” regarding the safety of a Mahindra Scorpio SUV led to the death of the complainant’s son.

The case was registered after Rajesh Mishra, who tragically lost his son Dr. Apoorv Mishra in an accident on January 14, 2022, approached a local court, which ordered the filing of the FIR. Among those booked at the Raipurwa police station in Kanpur is the car dealership manager, Anand Gopal Mahindra.

Mishra’s complaint states that he purchased a black Mahindra Scorpio SUV on December 2, 2020, for Rs 17.39 lakh. He made the purchase after seeing advertisements and social media posts by Anand Mahindra himself. Mishra asserted that he bought the vehicle with the safety claims in mind and subsequently gifted it to his only son.

 

On that fateful day, January 14, 2022, Dr. Apoorv Mishra, along with his friends, was returning to Kanpur from Lucknow in the car, and all of them were wearing their seat belts, as stated in the police report. Due to foggy conditions, the car collided with a divider, rolled over multiple times, and tragically, Dr. Apoorv lost his life on the spot.

The complaint goes on to emphasize that Mishra would not have purchased the car had it not been for the assurances provided by the dealership and the company’s advertisements. It further alleges that despite the occupants wearing seat belts, the car’s airbags did not deploy, resulting in the untimely death of Dr. Apoorv. Mishra contends that the company deceived him by providing false assurances and claims that he later discovered there were no airbags in the car.

The FIR has been filed under various sections of the Indian Penal Code, including cheating, negligent conduct with respect to machinery, causing death by negligence, intentional insult with intent to provoke breach of the peace, criminal intimidation, and criminal intimidation with threat of injury.

The investigation into the case has commenced, with the SHO of Raipurwa, Aman Singh, confirming that further action will be taken based on the findings. Singh stated, “The case was lodged after a court order for it. We have started probing the case and will share more soon.”

Why did airbags not deploy?

There is a point in the news reports about the incident that confuses us. The complainant has alleged that there were no airbags installed in the vehicle. This, we think, is highly unlikely – but then again, we do not know if the reports have described the allegations incorrectly.
