Road Rage: Hit and Run Case

Advocate Sandeep Hari from Hyderabad recently shared his experience dealing with hit-and-run cases. In a tweet, he described an incident where a car aggressively overtook him from the left on a narrow undivided road. This manoeuvre forced Hari’s car towards oncoming traffic, putting his life at risk. As a result, Hari’s car sustained dents on the left side, a deep scratch on the door, and a lost ORVM cover. The aggressive driving vehicle hit Hari’s car and then fled the scene.

While most of us are left helpless, Hari decided to take the legal route instead.

What is the Legal Procedure?

Hari has provided detailed steps and processes for dealing with aggressive driving in India, as many people are unfamiliar with the legal procedure. Firstly, Hari filed an email complaint on the day of the incident. Within 3 days, he visited the police station and submitted a written complaint. In addition, he submitted dashcam footage of the incident on a pen drive, along with the Sec.63 BSA certificate.

After receiving evidence and a complaint from Hari, the police filed a First Information Report (FIR) and completed the scene of the offence Panchnama. They also issued an official notice to the accused to appear for investigation. When attempts to reach the accused by phone were unsuccessful, an officer personally visited the accused to deliver the notice.

After this, the real drama began. The car owner, who was accused, was called to the police station to submit his original driving license, car registration, and insurance. During this interaction, the police discovered that the owner did not have an active insurance policy for the vehicle. Initially, the accused blamed Hari for the crash. However, the dashcam footage proved useful as it clearly showed the aggressive move from the accused.

Afterwards, Hari took his Ford Freestyle to the body shop, where he received an estimated service bill of Rs 27,000. Using this estimate, he filed a Motor Claim petition in a local court, seeking Rs 27,000 for repairs and Rs 13,000 for the mental anguish and loss of earnings caused by the incident.

Sleepless Night For Aggressive Driving

While the matter is under consideration or trial, we can see the benefits of the legal system. Without insurance, the accused owner will have to spend over Rs 1 lakh on service charges, advocate fees, and more. Additionally, this case will also consume a significant amount of his time and prove to be a problem when the owner tries to renew his passport.

Yes, the legal procedure is a lengthy one and Hari expects this case to continue for another 1-2 years before they arrive at a settlement. But this stands to be a strong example for anyone who tries to break the rules.
